Do you worry about waitstaff spitting in your food if you complain at restaurants?

After complaining about their food, an upstate NY couple found something extra in one of their sodas. A DNA test proved the waiter had spit in the drink.. The waiter confessed to the crime, plead guilty and will not be returning to the restaurant. Do you complain about food or do you avoid making a fuss because you fear retribution?
