In May 2017, Moutia Elzahed first made headlines when her husband, Hamid Alqudsi, was convicted of terrorism in Australia for recruiting fellow Muslims to join the Islamic State. Elzahed, who is one of Alqudsi’s 2 wives, immediately came to her husband’s defense by causing trouble for the authorities and court.

First, Elzahed filed a major lawsuit against the police officers who arrested her and her son, accusing them of “assault and battery, wrongful arrest, false imprisonment, and intimidation.” Luckily, the case was thrown out when Elzahed refused to give her testimony without her full-face veil, despite being offered a private meeting with the female judge.
When Elzahed was brought before Judge Audrey Balla of the NSW District Court, she refused to stand and honor the magistrate, citing her devout religious belief that she “only stands for Allah.” Unfortunately for Elzahed, Judge Balla had a fool-proof way to ensure that the Islamic supremacist stood the next time she appeared in a courtroom.
According to the Daily Mail, Moutia Elzahed, the 49-year-old Muslim woman who has given the NSW District Court trouble for over a year, immediately stood to honor Magistrate Carolyn Huntsman at Sydney’s Downing Centre Local Court on February 19 after she was charged with 9 counts of “disrespectful behavior in court.”
Approximately a year ago, Judge Balla warned Elzahed that she would be charged for her uncooperative and inappropriate behavior, a charge which also included a $1,100 fine or 2-week stay in a jail cell every time she refused to stand, according to The Sydney Morning Herald. This week, Judge Balla’s promise paid off as Elzahed rose for Magistrate Huntsman without hesitation.

Elzahed officially became the first person to be charged under the new “disrespectful behavior” laws, which differ from contempt of court charges but garner harsh penalties nonetheless. The legislation was reportedly introduced following international condemnation over instances of Muslims refusing to stand in the courtrooms.
Expectedly, Elzahed’s defense attorney, David Hume, argued that the district court was wrong to require Muslims to rise for judges, seemingly suggesting that they should be granted special privilege which exempts them from such rules.
“When the executive starts coming along and deciding when and how behaviour in the courtroom should be regarded, that presents a grave risk of conflict between two different branches of government,” he said.
However, Hume’s assertion is a fallacy, as Western courtrooms have long required those physically capable of doing so to rise for the judge out of respect for such authority.
The court has confirmed that there is nothing in Islam that would prevent a Muslim from standing when addressing a non-Muslim judge in a Western court of law. While the claim that there is nothing in the Quran prohibiting Muslims from standing, there are plenty of scriptures that condemn un-Islamic authority and command disobedience to any law other than Sharia.
- Quran (4:141) – “…And never will Allah grant to the unbelievers a way (to triumphs) over the believers.” This is at odds with democracy, which allows anyone to serve in a position of power over others regardless of religious belief.
- Quran (12:40) – “…Allah hath sent down no authority: the command is for none but Allah…” Sometimes translated as “None have the right to legislate except Allah.”
- Quran (4:59) – “O you who believe! Obey Allah and obey the Messenger and those in authority from among you…”Obedience is strictly limited to a government drawn from believers, not from the broader community. This verse has also been used to justify submission to autocratic rule, however oppressive it may by. As an Arab tradition put is: “tyranny is better than anarchy.”
- Quran (9:3) – “…Allah and his messenger are free from obligation to the unbelievers…” Muhammad used this “revelation” to dissolve a standing treaty and chase non-Muslims from their homes if they wouldn’t accept Islam. This practice would be incompatible with democratic rule, in which everyone is considered equal.
Western governments must never recognize any aspect of Sharia law above our own. It is wholly incompatible with our laws, values, freedoms, and culture because of its required supremacy.
